Software Products

4. License and Usage Rights

License Grant

Upon purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to use our software products for personal, non-commercial trading purposes on a single NinjaTrader installation.

Restrictions

You agree NOT to:

• Copy, modify, distribute, sell, or lease any part of our software
• Reverse engineer, decompile, or disassemble the software
• Share your license with others or allow unauthorized access
• Use the software for any commercial purpose without authorization
• Remove or alter any proprietary notices or labels

5. Intellectual Property

All content, features, and functionality of our Services — including but not limited to software, indicators, strategies, text, graphics, logos, images, videos, and educational materials — are owned by Trade With The Bull and are protected by copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right to use our trademarks, logos, or brand features without our prior written consent.

6. Risk Disclosure

By using our Services, you acknowledge and agree that:

• Trading futures and other financial instruments involves substantial risk of loss
• You may lose more than your initial investment
• Past performance of any trading system, methodology, or indicator is not necessarily indicative of future results
• No trading software or strategy can guarantee profits or prevent losses
• Market conditions can change rapidly and unpredictably
• Technical failures, connectivity issues, or software errors may result in losses
• You are solely responsible for all trading decisions and their outcomes

7. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that our Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any information provided through our Services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADE WITH THE BULL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Trading losses or missed trading opportunities
• Business interruption
• Cost of substitute services
• Any other damages arising from your use of our Services

Our total liability to you for any claims arising from these Terms or your use of our Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Trade With The Bull and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of our Services, your violation of these Terms, or your violation of any rights of another.

10. Refund Policy

Due to the digital nature of our software products, all sales are final. We do not offer refunds once software has been delivered and license keys have been issued.

11. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.
